These Terms of Service ("Terms") constitute a legally binding agreement between you and DamilanTech ("DamilanTech", "we", "us", or "our") regarding your access to and use of the ConvertCalm macOS application and damilantech.com website.

1. Acceptance of Terms

By downloading, installing, accessing, or using ConvertCalm, you confirm that you have read, understood, and agreed to be bound by these Terms of Service. If you do not agree with these Terms, you must immediately cease using the application and uninstall it from your devices.

2. Description of Application

ConvertCalm is a native desktop utility for macOS designed for batch image optimization, format conversion (PNG, JPEG, WebP, HEIC, AVIF, TIFF, SVG, GIF), quality adjustment, EXIF/metadata stripping, and 64-bit perceptual duplicate image detection. As of version 2.1, ConvertCalm also provides a Video & Audio Studio: hardware-accelerated video conversion and compression (MOV, MP4, MKV, AVI, WebM), video trimming, animated GIF generation, audio muting and extraction to M4A, creator/social media export presets, and native macOS automation via Finder Quick Actions, the Shortcuts app (AppIntents), and a convertcalm:// URL scheme.

3. License Grant & Permitted Use

DamilanTech grants you a personal, non-exclusive, non-transferable, revocable license to install and execute ConvertCalm on compatible macOS devices that you own or control. You may not:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of ConvertCalm.
• Modify, adapt, translate, or create derivative works based upon ConvertCalm.
• Rent, lease, lend, sell, sublicense, distribute, or transfer ConvertCalm to any third party.
• Remove, alter, or obscure any copyright, trademark, or proprietary rights notices.

4. Intellectual Property Rights

All title, ownership rights, and intellectual property rights in and to ConvertCalm (including but not limited to code, software architecture, user interface design, logos, graphics, icons, and text) belong exclusively to DamilanTech. ConvertCalm is protected by international copyright laws and treaties.

5. Local File System & User Responsibilities

ConvertCalm processes image, video, and audio files strictly on your local macOS filesystem. You acknowledge and agree that:

• You maintain sole ownership of and responsibility for all images, videos, audio, and files processed using ConvertCalm.
• You are responsible for maintaining independent backups of your original images and videos prior to performing batch operations, trimming, or enabling options such as automatic original file deletion.
• DamilanTech is not responsible for any file loss, accidental deletion, or data corruption resulting from user settings or system hardware failures.
• Hardware-accelerated encoding speed and output quality depend on your Mac's chip, model, and available system resources; DamilanTech does not guarantee specific export times or file sizes.
• You are solely responsible for any workflow you build using Finder Quick Actions, Shortcuts/AppIntents automation, or the convertcalm:// URL scheme, including any files sent through them to third-party apps or services.

6. App Store Purchases & Licensing

All financial transactions, payments, subscriptions, lifetime unlocks, and purchase restorations are processed exclusively through Apple’s Mac App Store infrastructure and StoreKit framework. Refunds and billing inquiries must be directed to Apple Support.

7. Privacy & Data Handling

8. Disclaimer of Warranties

ConvertCalm is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or error-free performance.

9. Limitation of Liability

To the maximum extent permitted by applicable law, DamilanTech shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of business, or device malfunction arising out of your use of or inability to use ConvertCalm.

10. Indemnification

You agree to defend, indemnify, and hold harmless DamilanTech, its creator, and affiliates from any claims, damages, liabilities, costs, or expenses arising from your misuse of ConvertCalm or violation of these Terms.

11. Modifications & Governing Law

DamilanTech reserves the right to modify these Terms at any time. Updated terms will be published on damilantech.com. These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
