Terms of Use

These Terms govern your download, purchase, and use of DockCalm. Please read them together with the Apple terms that apply to apps and purchases from the Mac App Store.
1. Agreement and eligibility
These Terms of Use (“Terms”) are an agreement between you and DamilanTech governing DockCalm and related support materials. You must be legally capable of entering this agreement. If you use DockCalm for an organization, you represent that you have authority to bind it. A parent or guardian must approve use by anyone who has not reached the age of legal majority.
2. Apple App Store terms
DockCalm is distributed through Apple. Your use is also subject to Apple’s applicable Media Services Terms and the Apple Standard End User License Agreement (“Apple EULA”) , unless a custom license displayed by Apple applies. These Terms supplement those rules. If a provision conflicts with mandatory Apple terms, the Apple terms control to the extent of that conflict.
The license is between you and DamilanTech, not Apple. DamilanTech, not Apple, is responsible for DockCalm and its content, maintenance and support, product claims, and intellectual-property claims, except where law or Apple’s terms provide otherwise. Apple has no obligation to provide maintenance or support. Apple and its subsidiaries are third-party beneficiaries and may enforce these Terms against you after your acceptance.
3. Lifetime purchase
Lifetime purchase
DockCalm is unlocked with “Lifetime,” a one-time, non-consumable purchase made directly through the Mac App Store, granting access to DockCalm’s covered features for as long as DamilanTech continues to make the purchased app version or a compatible successor available on supported Apple platforms. There is no trial and no subscription. It does not mean your natural lifetime, guarantee perpetual compatibility with future hardware or operating systems, or include unrelated future products or separately identified services.
Prices, restoration, and refunds
Prices may vary by storefront and may change for future purchases subject to Apple’s notice and consent requirements. Restore Purchases uses the same Apple Account and Apple’s transaction records. Family Sharing is available only if the App Store product listing expressly says so.
Apple processes charges, refunds, and revocations under its policies and applicable law. DamilanTech cannot issue App Store refunds directly. If Apple refunds or revokes a purchase, DockCalm may remove the associated access. Pending transactions do not grant access until Apple verifies them.
4. Limited license
Subject to these Terms, the Apple EULA, and valid paid access, DamilanTech grants you a limited, personal, revocable, non-exclusive, non-transferable license to install and use DockCalm on Apple-branded devices you own or control, as permitted by Apple. DockCalm is licensed, not sold. Purchase does not transfer ownership of software or intellectual property.
5. Restrictions and acceptable use
You may not, except where applicable law expressly permits it:
- copy, redistribute, sublicense, rent, lease, sell, publish, or commercially host DockCalm or your access entitlement;
- share an Apple Account, purchase credential, modified build, or circumvention method to give unauthorized access;
- reverse engineer, decompile, disassemble, modify, bypass StoreKit verification, or defeat technical protections;
- use DockCalm to access files, systems, accounts, or data without authorization, introduce malware, disrupt services, or violate law or third-party rights;
- misrepresent affiliation with DamilanTech or use DockCalm branding in a misleading product.
Nothing here limits rights that cannot legally be restricted, including certain interoperability or security-research rights. You may make ordinary personal backups as permitted by Apple and law.
6. Your content, files, and permissions
You retain ownership of names, notes, tasks, file references, dock arrangements, and other content you place in DockCalm. You represent that you have permission to access and use the apps, files, folders, and Shortcuts you configure. You grant DockCalm only the local permissions necessary to display, remember, open, or act on your selections.
You are responsible for the accuracy, legality, and safety of your content and for securing your Mac and exported files. Removing an item from DockCalm does not delete the original from your Mac unless the interface expressly tells you otherwise.
7. Widgets, Shortcuts, and third-party services
Widgets and controls may display system information or open macOS features. DockCalm depends on macOS APIs, permissions, hardware availability, and the accuracy of information provided by the system. Results such as CPU, memory, thermal, battery, storage, and network readings are informational and are not guaranteed to be laboratory-grade measurements.
Shortcuts and external links may invoke Apple or third-party apps, websites, automations, or services. Those products are independent and governed by their own terms and privacy policies. DamilanTech does not control or endorse third-party content merely because DockCalm can open it.
8. Backups, restoration, and diagnostics
Backup, recovery, and diagnostic functions are convenience tools and may not capture unsupported third-party data, files, credentials, or resources that have moved or lost permission. You are responsible for maintaining independent backups of important data and reviewing any exported diagnostic before sharing it. DamilanTech does not guarantee that every configuration can be restored on every Mac or future macOS version.
9. Updates, compatibility, and service changes
We may release fixes, security updates, improvements, or changes needed for Apple requirements and macOS compatibility. Some features may change or cease working when Apple changes macOS, hardware, permissions, StoreKit, or other dependencies. You are responsible for installing compatible updates made available through Apple.
We may modify or discontinue features or the app where reasonably necessary, considering paid access, legal obligations, security, technical feasibility, and consumer rights. We do not promise perpetual availability. If a change materially affects your purchased access, remedies will be handled under applicable law and Apple’s policies.
10. Intellectual property
DockCalm, its code, design, icons, documentation, names, logos, and other DamilanTech materials are owned by DamilanTech or its licensors and protected by intellectual-property laws. Apple, macOS, Mac, Mac App Store, and related marks belong to Apple Inc. Third-party app names and icons belong to their respective owners. No trademark license is granted except as necessary to identify the app.
11. Support and feedback
Reasonable support is available at [email protected] . Response times are not guaranteed. Do not send passwords or payment-card details. If you voluntarily provide ideas or feedback, you grant DamilanTech a worldwide, perpetual, irrevocable, royalty-free right to use it without obligation, provided we do not publicly identify you without permission.
12. Warranty disclaimers
To the maximum extent permitted by law, DockCalm is provided “as is” and “as available.” DamilanTech disclaims implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement. We do not warrant uninterrupted, error-free, or universally compatible operation, or that every file, app, widget, Shortcut, peripheral, display, or macOS version will work.
If DockCalm fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price, if any, as required by its terms. To the maximum extent permitted by law, Apple has no other warranty obligation. Nothing excludes non-waivable statutory warranties.
13. Limitation of liability
To the maximum extent permitted by law, DamilanTech and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, files, profits, revenue, goodwill, or productivity; device or software incompatibility; or unauthorized access arising from DockCalm, even if advised of the possibility.
Where liability may legally be limited, DamilanTech’s aggregate liability for claims relating to DockCalm will not exceed the greater of the amount you paid for DockCalm during the twelve months before the event or USD $50. These limits do not apply to fraud, willful misconduct, death or personal injury caused by negligence, or other liability that law does not permit us to exclude. Some jurisdictions do not allow certain exclusions, so portions may not apply to you.
14. Indemnity
To the extent permitted by law, you will defend and indemnify DamilanTech from third-party claims, losses, and reasonable costs arising from your unlawful use of DockCalm, your violation of these Terms, or your infringement of another person’s rights. This does not apply to the extent a claim results from DamilanTech’s own conduct or where consumer law prohibits it.
15. Suspension and termination
Your license ends if you materially breach these Terms or lose valid access, subject to any notice and cure rights required by law. On termination, stop using DockCalm and delete unauthorized copies. We may restrict functionality when Apple reports a refund, revocation, or an invalid transaction. Sections intended by their nature to survive—including ownership, disclaimers, liability, and dispute provisions—remain effective.
16. Export controls and sanctions
You represent that you are not located in a country subject to a U.S. government embargo or designated as supporting terrorism and are not listed on a U.S. government prohibited or restricted-party list, as required by Apple’s minimum terms. You will comply with applicable export-control and sanctions laws.
17. Mandatory consumer rights
These Terms do not waive rights or remedies that cannot be waived under applicable consumer law. If you reside in the European Economic Area, United Kingdom, Australia, Canada, California, or another jurisdiction with mandatory protections, those protections remain available. App Store purchase cancellation and refund rights may differ by location and are administered by Apple.
18. Governing law and disputes
These Terms are governed by the laws applicable at DamilanTech’s place of establishment, without regard to conflict-of-law principles, except that mandatory consumer law and venue rights in your place of residence remain unaffected. Before starting formal proceedings, please email us and allow a reasonable opportunity to resolve the issue. You may also use any consumer dispute mechanism available by law. Nothing requires individual arbitration or waives a right to a court or class remedy where such a waiver would need explicit consent.
19. General provisions
The Privacy Policy is incorporated by reference. These Terms, Apple’s applicable terms, and the information shown at purchase form the agreement about DockCalm. If one provision is unenforceable, it will be limited or removed to the minimum necessary and the rest remains effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without consent; DamilanTech may assign them as part of a reorganization, merger, sale, or transfer of DockCalm, subject to law. Headings are for convenience. Translations are provided for accessibility; if versions differ, the English version controls to the extent permitted by local law.
We may update these Terms prospectively for legal, security, technical, or product reasons. We will change the date above and provide notice when required. Continued use after the effective date means acceptance, but material changes requiring consent will not bind you without that consent.
